Civil Torts
Unlike criminal law, which deals with offenses against the state, civil torts are wrongful acts that cause harm or injury to another person and for which the law provides a legal remedy in the form of damages.
The person who commits the tort can be held liable for the harm caused, typically through monetary compensation to the injured party.
Torts can be intentional (such as assault, battery, defamation, or trespass) or unintentional (most commonly, negligence). Negligence occurs when someone fails to exercise the level of care that a reasonable person would in a similar situation, leading to injury or harm to another person.
Tort law serves two primary purposes: to compensate victims for their losses resulting from the harm caused and to deter others from committing harmful acts. Torts are civil wrongs, separate from criminal or contract laws, and are handled in civil court proceedings.
Civil Litigation Cases in Miami
Civil litigation is the legal process for addressing disputes between individuals or organizations that typically seek monetary damages for alleged wrongdoing or “specific performance” rather than criminal sanctions.
"Specific performance" is a legal remedy used in civil law when monetary damages are inadequate or inappropriate as compensation, such as for a breach of contract.
This remedy is often used in cases involving unique items or properties. For example, real estate is considered unique because no two properties are alike. If a seller breaches a contract to sell a property, the buyer may not be made whole by simply receiving money damages. Instead, the court can order the seller to proceed with the sale as initially agreed in the contract. This is an example of specific performance.
Civil disputes can often involve civil wrongdoing, known as “torts.”
